By downloading, installing, accessing, or using the Oberon EHS mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the App.

Oberon EHS is a digital health and safety assistant providing:

• Related workplace safety features

The App is provided for informational and operational support purposes only.

3. Eligibility

You must be at least 16 years old (or the digital age of consent in your country) to use the App. By using the App, you confirm that you meet this requirement. The App is not directed to children under 16.

4. User Accounts

You may create an account using email and password, or approved third-party authentication providers. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities under your account

You must provide accurate and lawful information at all times.

5. User-Generated Content

You may upload content such as incident descriptions, risk assessments, photographs, videos, and workplace hazard documentation. You retain ownership of your content.

By uploading content, you grant OPSS a worldwide, non-exclusive, royalty-free license to store, process, display, and use the content solely for providing the Service, improving the Service, and legal compliance.

You confirm that you have the legal right to upload the content, that it does not infringe third-party rights, and that you have a lawful basis to upload any personal data of third parties.

Content Moderation

Users may report inappropriate or unlawful content via in-app reporting tools or by contacting support. We reserve the right to review, restrict, or remove content that violates these Terms or applicable law.

6. AI-Generated Guidance

The App uses artificial intelligence to provide guidance and informational responses.

You remain fully responsible for workplace safety decisions and regulatory compliance. We do not use automated decision-making that produces legal or similarly significant effects under Article 22 GDPR.

7. Prohibited Conduct

You may not use the App for unlawful purposes, upload illegal, harmful, or infringing content, upload personal data of others without a lawful basis, impersonate another person, attempt to interfere with App security, or reverse engineer/scrape the App.

8. Intellectual Property

All intellectual property rights in the App, including software, design, logos, AI outputs, and branding, are owned by OPSS or its licensors. You are granted a limited, non-transferable, non-exclusive license for personal or internal business use.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, OPSS disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee uninterrupted or error-free operation.

10. Limitation of Liability

To the maximum extent permitted by law, OPSS shall not be liable for any indirect, incidental, consequential, or punitive damages. Total liability shall not exceed £100 or the amount you paid for the Service (if applicable). Nothing in these Terms limits statutory consumer rights under UK or EU law.

11. Account Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time.

12. Changes to These Terms

We may update these Terms periodically. Material changes will be communicated in-app. Continued use of the App constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the courts of England and Wales, without prejudice to mandatory consumer protections.
